Cancellation of ICT tier 2 earlier

Hello,

My ICT tier 2 will expire in December , which was issued in 2014. I have to now go back and work from India. Is it possible for me to cancel the ICT tier 2 immediately than waiting till it expires, so my cooling off period also starts immediately when Ieave now. So I can come back again soon when the next projects starts.

It is your employers responsibility to inform HO to cancel the visa NOT yours.

The cooling off period starts from the date you LEAVE the UK, regardless of how long your visa is still valid for.

Thank you. That gives me 2 more doubts

1. If I leave early (so the cooling off period starts when I leave) and If the employer inform HO when I leave, does it affect me when I apply next time after the cooling off period .
2. As the cooling off period starts when I leave, does my dependant spouse can continue work till December , or he has to leave with me ?

1. No effect on future applications. It your sponsor duty to inform HO etc.

2. No your dependent cannot stay behind in the UK. Their status is directly dependent on your status and if your visa is cancelled, theirs will also be cancelled.

If my employer doesn't inform HO when I leave early before the visa expiry, (understood my cooling off period start when I leave), does that give my spouse to continue his work and continue till the visa expire in December? Would that be illegal?
because there is an argument that I left without cancelling, so I can come back anytime before it expires..would that be a possibility?
