Tier2 Dependent or FLR(M) after ILR from Tier2 General

Hi,

I am new to this group. I arrived in the UK in Dec 2011 and got ILR in Nov 2016. My dependents got initial Tier2 dependent visa and then 1 extension as Tier2 dependents and their current Tier2 Dependent Visa expires in Aug 2017. Dependents have been staying only 3 months in UK every year. They still continue to stay only 3 months in a year in future also. I know they are not eligible for ILR, but I want to decide whether I should apply for Tier2 Dependent visa or FLR(M)?

Appreciate your help.

They can continue to extend their tier 2 dependent visas. No need to switch to FLR(M).

Thanks for the response. Could you please help me on these.

1. Since it will be Tier2 Dependent, does it not require a COS of Main applicant?
2. My dependents will be applying from INDIA. So, as per new rules do they have to arrive UK to collect the BRP card within a month or will they stamped for 3 years in the passport itself?
3. Could you please provide the checklist of required documents for them?

No. They are dependent on you not a sponsoring company, assuming they apply for an extension WITHIN the UK.
2. My dependents will be applying from INDIA. So, as per new rules do they have to arrive UK to collect the BRP card within a month or will they stamped for 3 years in the passport itself?
They don't qualify to apply for a Tier 2 general dependent visa from outside the UK if you hold ILR. They only have the option from outside the UK to apply for a spouse settlement visa and must meet ALL the requirements (English A1, Financial requirement etc). This will also reset their clock to zero for ILR.

All visas issued from outside the UK are valid for 30 days and the BRP with the full visa must be collected within 10 days of arriving in the UK.

Thank you for the suggestion. I am thinking to go for Spouse settlement Visa since there is no other option. Could you please advise on below queries.

1. How much should I maintain as the financial requirement for a partner and a child (6 years)?
2. Do I also have to pay healthcare charge when applying from INDIA?
3. Can I have a checklist of documents for this?

There is no 'maintenance fund' requirement. You MUST submit evidence, payslips and banks statements for at least 6 months, proving you meet the financial requirement of £22,400pa.
2. Do I also have to pay healthcare charge when applying from INDIA?
Yes, £600 EACH.
3. Can I have a checklist of documents for this?

Thanks for the response. I do not understand regarding financial requirement, do I have to maintain £22,400 in my bank continuously in 6 months bank statement?

Another question is can I get them here on Family visitor and once they arrive UK on Family Visitor then apply Spouse settlement Visa in UK?

You have to prove ypur salary is £22,400 a year. The is NO fund Maintenace fund for x amouny of months/days for a spouse visa.

No you cannot bring them on a visit visa and the switch in the UK to a spouse visa. This is not permitted. They must apply outside the uk if they cutrently have no valid visa.

I have a limited Company now. My accountant is running 8K salary per annum. Can I also show the dividends + salary together more than £22,400 ?
