ILR for family based on human rights

Hii there,

I really need your help! My family is in the uk right now and my father has been living in the Uk for more than 16 years (illegally) and my mother has been in UK for 5 years. We applied for ILR based on human rights in December. The application got refused so many times, now we have appealed in the court.

I have done my gcse's over here and currently in college right now. I'm about to go to university next year and I can't apply for student loan because I've not got my national insurance number yet.

My parents go to reporting centre. They used to call them after every 6 months and now it's after every 4 weeks. They asked about me and I'm about to be an adult soon. The solicitor didn't satisfy me. Could you please help me out

Where were you born? What is your current age? How long have you lived in the UK?

We applied for ILR based on human rights in December.
There is no such ILR category. It was removed in 2012 - 14 years long residence ILR (no visa status needed).

What application exactly did your 'solicitor' make, if you applied through a solicitor?

I was born in India, I've been living here for 5 years and I'm 17. The solicitor said that you might get a status due to the fact that there's no house for us to live in India and no family.

FLR leave to Remain application as a family refused

Hello i have been in this country for more than 6 years and i came here as a minor. I have been through secondary education and college over here. I am now 19. My dad has been here for more than 18 years without leave to remain or enter. We made an application to home office back in 2013 but got refused and made it again last year under human right and got refused again. They said its not evidenced that i cant continue my education back in my country but i cant as i dont hold any indian qualification. I have been brought up here and studied in the uk. So how can i just continue my education back in india? Is there any possible way i can convice them to grant us leave to remain. Thanks

Subject to suitability test you are entitled to a limited leave to Remain based on paragraph 276ADE (1)(v) of the immigration rules. There is no test for reasonableness on verse (v) which I believe is where you fall in. You must show that you have been in the UK for more than half of your life ...that is with your primary/Secondary school records discounting any periods of imprisonment. You must show you are between 18 and 25 years. You may get some form of attestation letters from persons of repute to confirm that you have been in the UK since then. Importantly you may also have to show the VISA and stamps of when you initially arrived here.

Your DAD must not apply with you here. Your DAD may be able to apply on his own after 20 years of continuous residency some part with or without leave.

Detained at a reporting event with parents

Hi everyone
I really need your help to sort this immigration situation out. I was detained ( at the age of 19 and I dont have any criminal record) with my parents in January whilst attending a reporting event. The HO lied and said they have sent us a letter saying that you are getting detained. Before I'll tell you my immigration history. My father have been living in the uk for more than 18 years and i have been living here for 7. I have been throught the british educational system. I did my gcse's and college in this country. We made an application back in 2013 based on private life and got refused. The old solicitor we had made an application to reconsider the decision. He kept on doing that for about 2 years. My parents started reporting in 2013 after the first refusal. They used to report after every 6 months then they made it to 4 weeks when i was about to turn 18. As soon as i turn 18 i started reporting with my parents. We made a fresh application last year based on human rights and got refused in dec. We sent a PAP letter to ho and when we to report thats when they replied and detained me and my parents. They keep saying that I can go back to india and continue my life over there but how can I go back when I dont even have any sort of educational record in india and i cannot continue my higher education back there. We have applied for JR and we got released on bail but still do report to ho every week. This is honestly very stressfull they know that I came here as a minor yet they detained me knowing that it isnt my fault.

Hi everyone I really need your advice. I was detained this year for about 4 weeks because my application got refused and I used to report to ho after 4 weeks. The ho didnt give me any right of appeal. So we sent them a PAP letter which they replied to when i was reporting to them and they detained me with my parents. My father have been living here for more than 18 years. I have been living here for 7 years. I have been through british education system yet they still detained. I came to this country as a minor so i have had my immigration history as a minor. I was banned from going to college. They took away my everything and made me look like a criminal bare in mind i dont have any criminal record. The ho said my removal was imminent and they sent us a letter that we are gonna get detained which is lie they never did. All they sent us was a refusal letter. We are out on bail and we report to them weekly and they torture us like anything saying that we will get removed forcefully if we dont do go back and they know that we are waiting for JR. We dont have anything back in India. My father have been away from india for about 20 years. There's no way i can continue my education over there. Is there anyone that can help me out pls.
