Spouse Visa Status After Divorced

Hi All,

First of all sorry for asking this question if it have been asked before.
Below is the description of my case.

I married to British National who lived outside Uk after born in UK in early 2014. In early 2015 our official ceremony happened and we started living together. I was doing doing job in Saudi Arabia. Welive there together till June 2017. I applied for Spouse visa on Financial route. I earn all the money and showed my saving of last 10 years. In this all process my wife got pregnant . She was house wife in Saudi and still not working in UK. We came to Uk in June 2017. After coming here my wife attitude got changed and even i come know she cheated and lie about marrying me as she had affairs with others. I just came to UK this new place for me. I just wanted to ask my spouse visa is valid still 2020. I know once we start the divorced process she will inform Home Office. Our marriage is not registered here, it registered in Pakistan. Is there any way i can stay in this country or i have to leave? Will she get any money/saving which i have if we divorced here in UK. I will be father in few month time as i cannot divorced her until baby is delivered.

Any advice will be helpful.

Your spouse visa will be curtailed/cancelled once your spouse informs HO. You will have to find a visa you qualify for and apply or leave the UK.

Once child is born and your are not living with your spouse and have evidence of involvement with the child, you could try FLR(FP) parent route.

What your spouse gets after divorce is NOT an immigration issue and you would have to deal with that during the divorce process.

Thanks for the reply. But this is something wrong on the part of government. Uk nationals do this and person who left everything have to suffer. This should be dealt on per cases base.

What if when child born n she left the country then. In that case i don't think so i can take FLR(FP) parent route.

Nothing wrong here, HO are not marriage counsellors. You are sponsored to be in the UK by your British spouse. If the relationship breaks down and you divorce, your British spouse is no longer your sponsor, why should you be allowed to stay 'because you gave up everything', there is no 'case by case' decision situation in the circumstances you describe. Find another visa you qualify for, there are other routes or you have to leave the UK.

FLR(FP) parent route will fail if she leave the UK with the child.

The counter argument here is people should chose their partners more carefully, especially when it comes to long distance relationships etc.

Why should UK gov and UK Joe Public pick up the tab for the wrong choice of partner by a non-British citizen?

I was my sponsor as i paid everything from my pocket. She is just a British citizen. Even on application which i applied clearly state that i m earning and i ll be the one earning in uk too.

How you will know that u have chosen wrong partner. When everything was ok and fine until you came uk.

Makes no difference. You are dependent on your British spouse for immigration purposes and for your right to remain in the UK. If she was not British or an ILR holder, you would not have qualified for a spouse settlement visa.

I can totally understand your going through very hard time rite now, but you have to follow the law of land, just imagine for a minute you spend all your life in Saudi would you be able to get the privileges of local ?? I don't think so you wont be able to get a Saudi passport or naturalization but at least UK give you the right to live with your family and also naturalization. Don't want to turn this into a political debate but CR001 and Wanderer are spot on.

There are other visa categories you could look into. Not sure why you are only focusing on the 'pack and leave UK' aspect. Most people would ask what the other options would be and do some research on them.

I have been in this country for few months. Don't know much bout immigration and other visa type. What i have been going through doesn't give me peace of mind. can't think much except going back. What r other option available to me?

Get a sponsoring employer and apply for Tier 2 General. Unless very limited conditions are met, you need to apply from home country. You can only work for your sponsor.

If you have £200k, apply for a Tier 1 Entrepreneur visa and start a business or join an existing business.

Then there is also the Tier 1 Investor (requires a lot more money) and Tier 1 Exceptional Talent (harder to get).

Tier 4 if you wish to study further (does not lead to ILR).
