Tier 2 General Curtailment Period

Hi All

Recently my company sponsorship license has been revoked. I haven’t received the curtailment letter yet. I would like to get few clarifications around the process in case moving to the new sponsor.

1) Do I need to apply for my dependents visa as well? I have been informed their visa is linked to me, not to my COS so I just have to apply for my visa. Their visa is valid till end of 2018.

2) After applying for a visa with the new sponsor, assuming it takes 30-45 days for the entire process. During this phase can I still serve my current employer? I have been informed if my visa is valid I can which is until 2018.

3) In a worse scenario, if my visa gets rejected with the new sponsor, how many days I would be getting after the decision. I presume it would be 60 days again and I would be entitled to work for those 60 days as well?

Your swift response would be highly appreciated.

1. Correct. U dont need to apply thier visa. only yours.
2. No. As i understand, as soon as the licence is revoked, from that day u cant work for them.
3. Depends if u have any visa left or not. But if it gets rejected, u wont get anything. U will have to leave immediately. More likely u wont get the passport back. U will be asked to coordinate with home office and collect your passport at the airport.

On the second point, On UK BA site found the below information, although it's for tier 4 but seems should be same for tier 2 as well

"In the event that the student’s place of study closes or they stop studying with 32 their sponsor before the completion of their course, the student will normally have their permission to be in the UK curtailed (cut short) to 60 days. During this time they may find a new education provider and course and apply to the Home Office for further permission to stay. During this period of 60 days, a student may work full time provided their conditions of stay permit them to work, and may continue to do so until the point that their application is decided. If, after 60 days, the student has not applied for further permission, their existing permission expires and they will no longer have the right to work."

On the third point, as per rule in case of visa rejection, they give you at least 14 days if you don't have a valid biometric card.

Why are you quoting information regarding student visas which is not relevant to your circumstances?

You are sponsored to be in and work in the UK. If your sponsors licence is revoked, you don't have a sponsor and cannot work.
