Tier-2 General Salary for Extension

Hi,

Tier 2-General EXTENSION

I am currently on Tier 2, SOC code 3538, my visa is expiring on 27/10/2017.
My employer has already requested the COS (not assigned yet) with salary of £28,000.

I have been reading online that experinece worker salary needs to be £30,000.00

I am confused as the following site says £27,000 salary is required for experienced worker.

Can someone please confirm what salary is required for my extension.

You seem to have missed an important few words:
Appropriate salary
You’ll usually need to be paid at least £30,000 per year or the ‘appropriate rate’ for the job you’re offered - whichever is higher. Check the appropriate rate for the job you’ve been offered.

For SOC 3538 - Experienced worker: £27,000 based on 39 hour week

For extension applications, the tier 2 guidance states that -
If you are applying for an extension or a change of employment application and your initial grant of leave was granted on the basis of a CoS assigned before 24 November 2016
£20,800 or the appropriate rate for the job, whichever is the higher

since I was assigned my current COS in oct 2014 so that means £30K rule DOES NOT apply to me and as the experienced rate for SOC code 3538 is £27k I should be alright with my salary of £28k for extension.

It would appear so.

However, with a £28k level of salary, you will fail to succeed with ILR in the future and any large sudden increase is a red flag to HO and likely to be investigated.

thanks for your reply.
Fortunately as soon as my 5 years get complete on Tier2 i will have my total stay in the country equal to 10 years. So I can go the 10 years route instead.

if you dont satisfy the salary requirement, u can still go for 10 year ilr, as long as u have a current leave.
