Argentinian National here on work visa. Can he switch employer?

Our company is looking at the possibility of hiring the above national. He is currently here on an employer-sponsored work visa. If we were to make him a job offer would he be able to join our company straight away or would he need to return to Argentina for a period?

I am aware our company must advertise the role for a period of 2 months unfulfilled prior to the possibility of hiring him.

If your company is an HO approved sponsor, then you are required to complete the full and proper RLMT for a minimum of 28 days on two websites as the guidance states, before you can offer this individual the position and issue a CoS. Only then can the candidate apply for a new Tier 2 General visa to change employers, assuming all requirements are met. He cannot work for you until his visa is granted.

You have to prove to HO that there is no settled/British or EU citizen suitable for the job.

Assuming he is on a Tier 2 General visa, he can change sponsors within the UK.
