Tier 2 ICT to ILR Entered UK on 23 May 2010

Hi,

I had VISA Tier 2 (ICT) Established Staff valid from 29/04/2010 to 27/05/2013 and I entered into UK on 23 May 2010. I got my WP extended till June 2015 with VISA type as T2 ICT Long Term Leave To Remain. Can you please confirm whether I am eligible for applying ILR. Thanks!

You are not eligible to apply for ILR via 5 years route, as you didn't have Tier 2 ICT leave before 6 april 2010. If you happen to stay in the UK job continuously until May 2020 with the same employer sponsorship, then you would be eligible for ILR via 10 years Long Residence route under the present UKBA rules.

On what date did you apply and PAY for your ICT visa in 2010???

Unfortunately I don't have the date on which my company have paid fee. But I got the email confirmation my employer quoting this on 15th April 2010.

That date is really important as if it was paid before 6th April, you fall under the old rules which permits ILR after 5 years residence.

Have you considered to do a Subject Access Request to HO for all the information they hold on you??
