FLR(M) Questions

Hi all, looking for a bit of wisdom on these forums. I've read a few posts on here and also have contacted the Visa office but just wanted to get some more opinions.

Summary:

- I'm a British citizen and my wife is from HK (we got married in Feb-18)
- She is currently in the UK on a Tier 5 visa expiring in Nov, so we are applying to switch to a spouse visa using FLR(M) - is this the correct form to use?

My questions are:

1. She already had a TB test for the Tier 5 visa so does she need one again for the spouse visa or can she use the one she already has? We've only been abroad on holiday for 1-2 weeks each time since she arrived in UK

2. She moved into my house around middle of 2017 (she was living elsewhere in UK before then) so basically all bills etc. are in my name only. She only has e.g. bank statements, mobile bills, letter from GP surgery in her name only and maybe one letter from our joint bank account. So we cannot provide the 6 or 12 pieces of proof of address the Home Office wants. I called and the Home Office said to just provide what you can and a letter of explanation. Does this sound right? What is the letter of explanation supposed to contain and can it be written by myself or does it have to be a lawyer? I'm also worried cus the form asks for 2 years of evdence but obviously we havent lived together for 2 years.

3. I can meet the financial obligations alone without any problems but I read somewhere the evidence has to be dated within 28 days of the application / appointment? (We are planning to use the priority service centre). So i only have to give payslips up to 6 months of the appointment date and I should be fine?

Sorry forgot to ask as well...she has a BNO passport as well as a HK passport. She used her BNO passport for the Tier 5 visa so I'm guessing for the spouse visa she should also use the BNO passport but just mention she also has HK nationality on the form?

Not required for FLR(M).

2 years mandatory cohabitation evidence is for unmarried partners and not for FLR(M) as spouse if you recently married. Send what you have since living together.

6 months payslips and 6 months corresponding bank statements showing the salary going in. The most recent payslip and bank statement must not be older than 28 days.

You do realise the fees are going up on the 6th?? Have you booked an appointment at the premium centre yet??
