Immigration on 10 years rule

Post by Naveedawan » Mon Apr 02, 2018 2:38 pm

Hi,

I came in UK on 17th September 2008 with my six months old son. My husband joined us on 7th Novermber 2008 as my dependant. I came on a student visa, to do 2 years MBA course. I completed my course in 2010 and got Post Study Work visa valid until Oct 2012.

In Oct 2012 I got admission in Phd and switch to student visa again valid until 3rd August 2017.

After successfully completing my doctorate degree I got one year DES (Doctorate Extenion Scheme) visa from the same University, valid from 25 June 2017 to valid until 30th June 2018.

During my stay in UK my family increased as well. Now I have four dependants including;

Husband
Son (came in UK on 17th September 2008 and staying in UK for more than 9 years)
Son (born in UK)
Daughter (born in UK)

Recently,I am working as a full time teacher in a primary school in London. My husband is also working full time.
We have been paying all the taxes, no conviction in court and no driving points.

Also, we have never stayed out of UK for more than 28 days on holidays and there has been no gap between our visas' start and end dates.

My query is as follow:

As my and my elder son's first entry date in UK is 17th September 2008 and my current visa is valid until 30th June 2018.
There is a gap of two and half months to complete our ten year stay in UK. How I can cover this gap to apply for 10 year immigration visa?

Many thanks for your consideration. Looking forward to your reply.

You will have to extend your visa into any permittable categories or at least will need section 3C by applying for any permittable categories of visa.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

What if you apply for FLR (fp) relying on the fact that your child has resided continuously for over 7 years in the UK. I think it would take more than 2 months to deal with the application and once you have completed 10 years in the UK you can vary the application to ILR on 10 years long residence. The aim is just to buy you time so that you can complete the 10 years.
