If a British citizen has previously sponsored his spouse for a settlement visa but the relationship then breakers down and he divorces her. After the divorce he gets married to someone else outside EEA. Are there any restrictions in the regulation which will bar him from sponsoring his new wife?
I just read the following guidance from the Home Office which in 3.2 (xviii) suggests that the relationship ma not be considered as genuine and subsisting if you have previously sponsored another partner to come to the UK: https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/263237/section-FM2.1.pdf
Can anyone please help with this question?

Hi,
The Answer is 'no'. if you can prove previous marriage ended legally and latest marriage done legally (with documents to prove).
I was in same situation and was able to sponsor.

My spouse visa application was submitted online on 3 May 2018 and she used a walk-in without appointment service at the VFS application centre in Karachi to enroll biometrics on 4 May 2018. This is because the earliest appointment that we booked online was for 9 May, so we had to cancel this appointment (the online application requires to book an appointment before making the payment for the visa fee). I sent all supporting documents to Sheffield on 11 May which were delivered on 14 May.
Visa4UK website is still showing status of the application as incomplete and there is still option to book an appointment. Is this normal? Do I need to do anything about it as it should show the status as complete?

As long as you have confirmation that Bio-metrics and also application has reached Sheffield it is ok.

I have submitted entry clearance application (Settlement) for my wife and I’m her sponsor. Due to some relationship issues, I want to withdraw the application. Does anyone know whether I can widraw the application as I’m the sponsor (not the applicant)? If so, what is the process? Do I need to email UKVI?
If I’m unable to withdraw the application, can I withdraw the sponsorship? Do I need to email UKVI?

Has she not received the outcome of her visa application yet?
Bear in mind that if you withdraw or notify HO, any future applications will be heavily scrutinised

@CR001
No she has not received a decision on the application yet. We are having a lot of issues with the relationship that I don’t see a future. I’m worried if she gets the visa approval and then we end up divorcing, it will be more difficult

Link below is the form used when a spouse is already in the UK on a visa. Not sure of the process for your circumstances.

I have received back supporting documents for spouse visa from UKVI Sheffield today. They have also returned original Appendix 2 of VAF4A, which I was expecting to be retained by them. Do they usually return Appendix 2?
I’m worried that they may claim Appendix 2 was missing from the application.
Please help me with this question

Nothing to worry about it’s normal everyone receives them back, they scan everything and return all documents including the online application form and appendix 2.

@arfinkhan128 Thanks for the reply. UKVI has also returned two passport size photos of the applicant, which I thought will be retained by them. Do they also return passport size photos of the applicant?

Only one photo is required which gets attached to the application form photo box which gets returned as well
i have recently read on this forum where another members passport photos were returned with the documents as well so I wouldn’t worry.
