Child Settlement Visa

Post by jano » Thu Nov 01, 2018 9:07 pm

Dear friends

I came to UK on tier-1 then took ILR and currently hold British passport.

My wife is still on PBS dependent visa, she got her first visa on 2014, then extension on 2016 her visa expires in Jan 2019, but she was out of UK from October 2017 - till date. As per my understanding the 180 absence rule doesn't applicable for her since the visa granted prior to Jan 2018 and she can apply for ILR without going for another extension is that correct ? The SET(o) application has to be used for the ILR application.

If she needs an extension,Is it possible to apply for the PBS dependent extension outside UK? if yes, doesn't going to affect future ILR application ?

Our child born outside UK so what visa category we can apply for the child?

Thanks,
Jano.

Absences requirement does not apply to PBS dependants who were granted visa before Jan 2018.
She will be eligible to apply for ILR after her return to the UK. Your child will follow the path of the less privileged parent, assuming your child was born before you were granted British citizenship (otherwise the child is British by birth).
So the child needs PBS dependat visa to enter the UK with the mother. In the UK, your wife plus the child will apply for ILR together and both will be granted ILR.

ILR application

Post by jano » Thu Apr 04, 2019 9:29 am

Hi Team,

I applied for ILR for my five months old baby from India. Unfortunately I missed the TB certificate rule and I missed to submit it. I am unable to get the TB certificate now since the passport is with UK embassy the clinic requires original passport to issue the TB certificate for the visa application. Is there any way to get the passport while the application under consideration.

If my application got rejected how soon I can re apply. Do I need to wait for six months to submit a new application.

Thanks,
Jano

You can't apply for ILR outside the UK as advised in November last year when you asked the same question (topics now merged).

Where is your spouse, abroad or in the UK??

Also, what form exactly have you completed and what visa does your spouse hold now??
