Spouse visa - Going out of UK for a long duration

Post by rshelar » Wed Nov 14, 2018 10:50 am

Hi,

I am a naturalised British Citizen and my wife is here on a spouse visa. She is on the first term of 2.5 years and we will be renewing soon.

What happens if we go out of the UK for few years and then plan to come back to the UK?

I assume in that case I need to be in the UK for a year before applying for a spouse visa again? Will that reset the ILR count?

Please advise.

Thanks

You start again from scratch visa wise and under whatever requirements are in place at that time.

Normally being out of the UK for more than 90 days in any tax year will have you seen as non resident.

It may be worthwhile checking the actual days allowed but your intentions will without any doubt annul the residence permit and put you right back to square 1.

And have the HO wanting to know your intentions if they are to issue another visa.
