FLR(M) - Confusion regarding Adequate Maintenance

Hi all,

Thank you so much in advance for any help you can provide me.

My husband and I are confused on how the Adequate Maintenance for accommodation is calculated and I hope someone here can enlighten us.

For proof of income, we are going to use my husband's salaried employment over the past 6 months, which is above £18,600. We live together in rented accommodation and we both contribute equally towards rent and bills. We have been supporting ourselves just fine without any access to public funds.

We found a formula in Appendix FM on how to calculate adequate maintenance: net income - housing costs = an amount that must be higher than "the amount of Income Support an equivalent British family of that size can receive"

The question is, do we need to provide evidence of how much each of us contributes towards the housing costs? Should this also be for the past 6 months? Do I also need to provide evidence of my salary as well so it goes into the calculation of the net income?

If either of you earning at least £18600 through salaried/non-salaried employment then HO would not look on your expenses. Remember adequate maintenance is for those who claim public funds/benefits to meet financial requirement.

We definitely got the two mixed up, thank you so much for clearing this up!

We thought they look at expenses for all applicants when they assess whether we have adequate accommodation or not. This is because the online form asked us for evidence of housing costs... We will be providing our tenancy agreement and council tax letters to show this. The online form didn’t mention the other bills (gas, electricity, tv, internet...).

As part of our correspondences, we will be providing a statement from our joint bank account, so they will be able to see that our rent and council tax goes out from that account.

We’re currently trying to book an appointment at a PSC for November (given up on December), but if we don’t manage then we will send the documents by post before 29 November. The worry is that we already paid the IHS so will try to get the application in ASAP.
