ILR Applicant's Dependants Application

Hello admins,
I’m planning to apply ILR based on 10 years long residence.
I applied for T1 Ent. Extension application (including my dependants) result not decided yet.
All documents in the Home office. In this stage query in bellow:
1 ) My ILR application will be SET (LR). What application for my dependants (wife & 2 years child) at the same time?
2) Some says FLR(M), some says FLR (FP) what’s the differences ?
3) My child born in UK, is he eligible for settlement same time with my application? If Yes, which form/application please.

1. FLR(M) and meeting the English and Financial requirements.

2. FLR(M) is a 5 year route to ILR, less complicated and less chance of refusal than FLR(FP) which is a 10 year route to ILR.

3. No. Set LR does not permit dependents to apply for ILR with you. The child can register as British on form MN1 once you have ILR.

Many thanks. I've doubt regarding FLR (M). In the guidance they clearly mentioned bellow things. As I'm not settled yet under which category my dependant apply. could you please clear this.

Finally, check you are applying for leave to remain in one of the following categories covered by
this form FLR(M):
• Family life as the partner of a person present and settled in the UK (2 year route)
• Family life as the partner of a person present and settled in the UK (5 year route)
• Family life as the partner of a person in the UK with refugee leave or humanitarian protection
(5 year route)
• Family life as the dependent child of a person who has, or is at the same time applying for,
limited leave as the partner of a person present and settled in the UK (other than under the
point based system or UK Ancestry), or the partner of a person in the UK with refugee leave or
humanitarian protection (2 or 5 year route)
You and any children under 18 making an application must be in the UK to apply. Anyone applying
for an extension of stay in the above-mentioned categories must apply - also on form FLR(M) - for a
biometric immigration document, otherwise known as a Biometric Residence Permit (BRP).

This one if you meet all the requirements. It will reset your spouse's clock for ILR to zero and a new 2 x 2.5 year visas before ILR can be applied for.

She does not have to apply at the same time as you and can apply AFTER you get ILR but must apply before her current visa expires.

If you plan to register your UK born child as British, you do NOT have to apply FLR(M) for the child.
