Urgent Visa extension Tier 2 Salary requirement

Hi,

Our companies sponsorship license has been expired so they have already applied for a new license and we are waiting for its decision.

I am having a visa till June 2019 but with this unfortunate circumstances i have to apply for new visa.
I have not received any curtailment notice till now whereas my colleague has received it but i will try and apply for a new visa as i am expecting the curtailment notice anytime soon.

My question is now to apply for a visa extension for tier 2 as an experience worker under new license do I have to show a salary of 33k for SOC code 2122.
if yes I am getting 28k at the moment can i show the car allowance which i use for personal use and pay tax on it will that make any difference.
I can show P11D Expenses and benefits which are 5147 + my salary which makes it 33k.

Please note: I have got tax calculations letter from HMRC in october 2018 showing My total income 33195 ( salary +car benefit)

Please do help me with your advice and let me know as i am going to apply soon.

Hi,

Thanks for your reply really appreciate it,

I believe as i have got 35 hrs working, that will be benefited as they count per 39 hours.
and I have asked my accountant he has confirmed that car allowance + salary is your total income. which i have recieved a letter from HMRC as well.
Car benefit is written in my contract letter as well and i have got P11D for all the 4 years.

Hope Home Office agrees to it.
