ILR SET(0) Tier-2 ICT dependent

Hi Guru,

If you can help me.

I entered UK in Feb-2010 on ICT visa(before 06 April 2010) and my company been extending my tier-2 ICT visa until I got ILR in Jan-2015. I

married in June-2012 and my wife is on PBS dependent since August-2012 and have always extended her application under Tier-2 ICT PBS dependent within country(UK).

She is eligible for ILR since September 2017 and we have sent her application in August 2018 as SET (0) PBS dependent.

Not sure but we have not heard back yet and it made me think below.

I was permanent employee until July 2016 and since then have started own limited company for IT contract and since then employed under company as director for 80% and my wife is 20% director and company secretary and also She is also working full time since July-2014.

As she is earning more than we required (£2800 full time salary + £400 company director/secretary after taxes/ni) I am drawing minimum net salary £962.04/month net pay.

Not sure but does that impact her application in anyway or is there any minimum requirement for income of me to above certain level for her to qualify for ILR.

We have applied below documents.
(1) SET (O) Form for PBS Dependent 07/2018 version
(2) 2 Photographs
(3) Main applicant passport and BRP
(4) My Passport and BRP copies
(5) Cohabitation proof since her last PBC dependent visa renewal and joint mortgage statement
(6) Main applicant and My payslips
(7) Bank statements
(8) Life in UK test certificate
(9) English knowledge NARIC red route 2 certificates

If anyone can please help to verify above?

There is no minimum income requirement for PBS dependent applying for ILR. Not sure why you think this would be an issue?

I have read somewhere that for ILR Original visa holder(in this case me Tier-2 ICT I am on ILR since Jan-2015) need to earn certain amount to sustain his/her family needs and not depedend on state benifits.

I am withdrawing minimum salary from my company and not sure if my minimum income will be above that threshold limit so my spouse can get ILR? Or Am I reading wrong information?

You have read wrong. You do need to show you can maintain yourselves, but here is NO minimum income level.

You are confusing the requirements of meeting the specific income level for SET(M) ILR, spouse settlement visa holders.

Thanks CR001, you are right I must be confusing other requirements for my spouse application, also documents I listed above with our income and other should be enough? We do pay mortgage of £1380 just for reference.

HO is only interested to see that you have income to support your dependents.

Hi CR001 thanks, and when you say you have income to support your dependents? Does that mean combine income and not just my income?

Thanks CR001, you are very much correct and we are overthinking just because we have not heard anything back from home office except 05/09/2018 for biometric. Also do you think other documents we have provided enough to support application?

There is nothing you can do but wait.

If you submitted what was required, there is no point worrying about anything now. Decisions can take a few weeks, sometimes up to 6 months.

Hi CR001,

We just realised, we had dividend from my ltd company of minimum amount of tax free around £5000 for me and £2000 for my dependent.

Under SET-O it ask for monthly income and we thought dividend is not monthly income so we have not mentioned it.

Should we ok for that or should I send letter to UKVI explainng it?
