Need advice for ILR

Need advice for ILR

Respected members

I have a Ltd company in which me and my partner are directors. My partner is British and full share holder. I recently got the extension which expires in 2020.

However we recently have immigration visit to our office. Where they found 2 illegal staff working as my partner recruited them.

When officer asked me that my partner has the more share capital I said yes. As he was not there in office they rote a letter with his name on top for civil panality.

Now we are waiting for letter from Ukvi I am sure we will get panality.

Kindly advise me as my ILR due in April in business bases. I am worried that it will affect me or not. As I got my intital visa in may 2014. And I am completing my 10 years in sep 2019.

Yes it can have an effect as you both are responsible for hiring illegal migrants as directors. You could be refused ILR

Thank you for the reply.

If he is going to pay the panality because he hires them. After paying the panality does it still effect my ILR if I go on 10 year base. He is 100 percent shareholder in company.

Please advice me what options I have

This is up to the Home office. Also what kind of business partnership is that where you have no shares :?

I don't believe you can pass the sole responsibility regarding hiring illegal workers onto your Co-Director.

See the following from the HO official guidance:
Entrepreneurial teams
1. Your team has an equal level of control over the funds and (where relevant) equal status
as owners, directors and/or members of the business or businesses in question.

(Casa, not CR001)
