Is old BRP with old sponsor valid to travel once decision by UKBA has been made for new visa and new BRP card is delayed

Post by nsf31 » Fri Dec 14, 2018 1:10 am

Hi All.. This is a query with regards to a delay of my new BRP Visa card with the new sponsor (after a decision receiving decision as positive). In the amidst of this delay a situation has suddenly arisen where I have to travel to my home country abroad for an emergency with close family members health condition.

What are my options?

Can i travel to my home country without my new BRP if I have my old BRP with me? Is old BRP still valid to travel? For details My old BRP has validity date printed as 03/07/2019. The start date on COS of new BRP is 04/02/2019. I'm currently serving notice period with old employer and am travelling and will be back while I'm still working with old employer. I also have my valid passport on me.

If the above is not possible can I still travel to my home country n apply for one off BRP and then replacement BRP? Or can I apply for an emergency document in my home country. Please advise soon as I have to fly coming Monday 17 Dec 2018 (tickets confirmed).

Any other suggestions are welcome.

Your prompt legal advice in this matter will be highly appreciated.

Thanks in advance.
Best regards Sher

Your old brp has been cancelled when new visa approved so no you cannot travel on it.

You don't state what date it is that you received approval??

Hi. Thanks for your response. I received my visa decision email on 4th December 2018 which mentioned I will receive the BRP within 7 working days.

Also another question is it possible to travel abroad with old BRP and be posted the new one-so that can return back on the new BRP?

Will it affect immigration history in any way? And can this happen smoothly?

Also incase new visa is lost in post - can I apply for a temporary One off entry BRP or replacement from my home country? And if my BRP delivery is delayed for several weeks and I am unable to receive it in post can I apply for a temporary BRP? Also is this procedure straight forward or complicated?

You don't need a BRP to LEAVE the UK. You need it to get on a plane and re-enter the UK. You would have to ask someone to send it to you. HO won't send it overseas.

No, not if you enter the UK with your new BRP.

BRP cards are not posted. They are delivered by DX Couriers, call then and see if they have a package for you. There is no such thing as a 'temporary BRP' and a replacement can take up to 6 months. There is also no such thing as a 'one off entry BRP'. You have to apply for a replacement single entry visa vignette after you have reported your current BRP as lost or stolen and as you don't have the BRP data and information.
