Naturalization of Child

Naturalization of Child

Dear Sir/Madam

I am asking this query on behalf of my colleague. She has got indefinite leave to remain in this month on Tier 2 route. Her son is about 4 years old. Query is

1) Can she apply for British passport for her son immediately or she has to apply for naturalization now?

2) If she has to apply for naturalization which application form needs to be submitted for her son?

Where was the child born, UK or abroad?
1) Can she apply for British passport for her son immediately or she has to apply for naturalization now?
Children are REGISTERED not naturalised. Only a British citizen can apply for a British Passport. The child is NOT British.
2) If she has to apply for naturalization which application form needs to be submitted for her son
MN1 is the form to REGISTER a child as British. Whether the child can apply depends on where the child was born and what the immigration status of the other parent is.

1) Child was born out of UK. When child was born she (single mother) was on Tier 2 visa. Father was out of UK at that time.
2) She is single mother, now she has indefinite leave to remain based on Tier 2.

I understand from your response she has to apply for naturalization for her son using MN1 form. Please advise me I understand correctly

1) Child was born out of UK. When child was born she (single mother) was on Tier 2 visa. Father was out of UK at that time.
Children born abroad are expected to hold ILR to qualify for citizen and can only apply when one of the parents apply and the other parent holds ILR. Does the child hold ILR? What is the child immigration status?
2) She is single mother, now she has indefinite leave to remain based on Tier 2.

Registered NOT naturalised. Only adults are naturalised. Child can only register as British when your friend does and if child holds ILR.

Does the fathers name appear on childs birth certificate and is the father involved with the child in anyway?

In addition, what role does the father of the child play in the life of the child?

Can the mother prove sole responsibility?

Even if she can, the child can be registered as a British citizen when the child has ILR AND the mother is either a British citizen or is applying to become a British citizen.
