Tier 2 General guidance updated for ILR

Hi All,

I can see guidance on application for UK as Tier 2 visa recently updated by HO. Point 264 in the pdf

Can someone help me if I am eligible to submit an application on or after 11/Jan/2019 due to the recent change.

Assume if I submit application on or after date 11/Jan/2019 and I have calculated back dated

Year 1 = 11 Jan 2019 - 10 Jan 2018 -> 0 day outside UK
Year 2 = 11 Jan 2018 - 10 Jan 2017 -> 28 days outside UK
year 3 = 11 Jan 2017 - 10 Jan 2016 -> 33 days outside UK
Year 4 = 11 Jan 2016 - 10 Jan 2015 -> 10 days outside UK
Year 5 = 11 Jan 2015 - 10 Jan 2014 -> 133 days outside UK ( Here is my concern- As my entry in UK is 29 June 2013 and I went back to India on 27th Sept 2014 and again can back on 25th May 2014). Therefore 133 days I have calculated as Jan + Feb+Mar+April + May till 24th which is equals to 133 days.

I would be really appreciate if you can help us and share your view if I can submit my application ?

Presumably you are a Tier 2 main visa holder (your post doesn't say if you are or if you are a PBS Dependent)??

Have you read the point correctly regarding 12 month cycle absence counting backwards from date of ILR application for visas issued BEFORE 11 January 2018??

Not really sure what your concern is though?

Seems it is pretty clear and is not a 'new' change. The changes were announced and published end of last year.
As my entry in UK is 29 June 2013 and I went back to India on 27th Sept 2014 and again can back on 25th May 2014).
Are your dates correct?? Useful to also state your immigration history/visas held!!

Firstly, thank you for quick response.

Here are few more details

1.Yes I am on Tier 2 General visa main visa holder
2. Visa start date 12 June 2013
3. 1st Entry in UK - 29th June 2013 and stayed 27th Sept 2013
4. Then came back again on 24th May 2014 and then below date's calculation is as is.
