PBS Dependent - which category to choose?

Hi,

My husband was on a "Tier 2 (General) Shortage Occupation - over 3 years" visa and got his ILR recently.  I am his dependant. I have gone through the various discussions here and understand that I have to apply as a PBS Dependant to extend my visa.

I need only 2 more years to be eligible for ILR. However, in the online visa application, when they ask for my husband's previous visa category, it would be "Tier 2 (General) Shortage Occupation - over 3 years" which would mean an IHS surcharge for £1000 and an almost similar application fee as the application would be for 5 years.

My doubt is whether I can extend my visa choosing the "Tier 2 (General) Shortage Occupation - upto 3 years" since I would be granted a visa for max only 3 more years considering the 6 year max for Tier 2 visas, or if I have to go exactly according to what my husband's previous visa category was. If so, would any of you know if I maybe able to get a refund?

If the main PBS applicant has ILR via the PBS route, then the PBS partner’s extension will be granted for three years.

Thank you Vinny! Just to confirm, does this mean that I can choose the "upto 3 years" visa option, unlike my husband's previous Tier 2 visa?
I read the following from the link that you had shared -
"For your spouses extension, put your ILR expiring date 3 years forward to get the correct Ihs of £600."
Was this specific to the case where they didn't get the BRP? Would it be seen as 'incorrect information' since I know the exact expiry date of his BRP.
