My husband was on a "Tier 2 (General) Shortage Occupation - over 3 years" visa and got his ILR recently. I am his dependant. I have gone through the various discussions here and understand that I have to apply as a PBS Dependant to extend my visa.
I need only 2 more years to be eligible for ILR. However, in the online visa application, when they ask for my husband's previous visa category, it would be "Tier 2 (General) Shortage Occupation - over 3 years" which would mean an IHS surcharge for £1000 and an almost similar application fee as the application would be for 5 years.
My doubt is whether I can extend my visa choosing the "Tier 2 (General) Shortage Occupation - upto 3 years" since I would be granted a visa for max only 3 more years considering the 6 year max for Tier 2 visas, or if I have to go exactly according to what my husband's previous visa category was. If so, would any of you know if I maybe able to get a refund?
