EEA2 to ILR

Hi
I came in London 3rd oct 2008 as student than 2011 got PSW visa. Again 2013 got student visa and Marry my EEA partner on June 2013 and got EEA2 visa in 2014. Some reason Jan 2016 HO revoke my EEA2 visa and provide appeal right. I did appeal on time Nov 2017 first tier dismiss my apple, apply to UT and UT grant my appeal and send back to first tier again for new fact finding. In Dec'18 Fist tire again dismiss the appeal and now I am going UT again. However at the moment I complete my 10 years in Oct'18. My question is can I apply 10 years route ILR or not? or until not win my case I can't apply. If I apply before UT decision HO will refuse my application. Please let me know.
