Hi Everyone,


I have a few questions hopefully somebody will answer me. my wife is on tier 2 dependant visa for delivery she went to India, my baby born in India.

Firstly I am on tier 2 visa hopefully by April I will get ILR visa.

1. What visa I have to apply for my baby if I get ILR??
2. Do I need to pay IHS charges for my baby?
3. My wife has Tier 2 dependent visa up to 27 March 2020. but she spent 180days outside of UK. so she may not eligible for ILR on 5 years route. So what visa I have to apply for her after I get the ILR??
4. I heard from mid-January 2019 IHS charges are going to be double instead of 200£ do we have to pay 400£ is this true??

Same visa as your spouse, PBS Dependent visa.
2. Do I need to pay IHS charges for my baby?
Yes.
3. My wife has Tier 2 dependent visa up to 27 March 2020. but she spent 180days outside of UK. so she may not eligible for ILR on 5 years route. So what visa I have to apply for her after I get the ILR??
When was her current visa issued or start date??

Yes, increase comes into effect on 8th January. It will be £400 per year.

Your child will get the same visa as the less privileged parent, ie your wife. If you want a settlement visa for your child, you have to apply for the same visa for your wife too.

No, children have never been exempt. However, had your child been born in the UK, the child would not need a visa and you would have been able to register the child as British as soon as you got ILR.

May 2017
The absence limit does not apply to her as her visa was issued BEFORE 11th January 2018.

Yes the child will get a visa with the same expiry date as your spouse and they will both have to apply for extension.

Yes, I know I have read what you stated. I was merely pointing out that by choosing to have the baby in home country, you have added a lot of unnecessary costs which could have been avoided completely if the child was born in the UK.

Thanks for your all valuable answers, appreciate your effort. It is true we can avoid a lot of unnecessary costs.
But hopefully, the last question when I am going to apply for my citizenship(naturalization), I am able to add my baby for citizenship too. is that right?

No you cannot. The child will follow the same path as your spouse and will require ILR before the child can be registered as British. Your child has no entitlement to register as British due to being born abroad.
