British Citizenship – overstay?

Hi All,

I am looking to apply for my citizenship and have a question around the Good Character requirement. I had a Tier 1 General visa which was expiring on 03/05/2014 and applied for my ILR on 03/04/2014 which is well within the stipulated window of time however Home Office only approved and sent my BRP after about 3 months. The BRP has an issue date of 21/08/2014.

Looking through different threads on these forums, I am concerned that they may reject my request for citizenship on the grounds that I may have I have breached immigration rules between my Tier 1 expiry date (03/05/2014) and when I got my ILR (BRP issue date 21/08/2014).

At no point was my application rejected and that it just took that long for them to review and approve my application. I actually had approached my local MP’s office and they helped me by chasing HO up. It had turned out that they had some issues with the printing of the BRPs and I wasn’t the only one affected by this. I unfortunately do not have any correspondence of this as my ex-wife at that time was coordinating this with the MP’s office.

Will this affect my citizenship application? If yes, what can I do to address this?

You are overthinking.

If an application for ILR was submitted before your tier 1 expiring date, once your visa expired you are protected by section 3c of the immigration rules and your tier 1 visa conditions continue while HO processes your application.

You were not an overstayer!!
