Tier 2 dependent visa

Hey guys,

I have just been granted a tier 2 (general ) cos so I can go back to my country to apply for the visa. However, my girlfriend is on a tier 5 yms visa so we will probably get married after I got the visa so she can get a dependent visa.

My employer for some reason only apply for a 2 years cos so my visa will need to be extended in 2 years time. I think I should be able to keep extending it until I can apply for ilr. But for my gf can she also get dependent visa until she clocks 5 years? I read that there’s this 2x2.5 thing she can do but my initial visa is only going to be 2 years so I don’t know if she can get 2.5 years for her visa? Or can she just keep applying for a dependent visa every time I extend my tier 2 visa?

I’m new to this forum but the comments I have been reading are super helpful. Really appreciate it if someone can help me out with my situation. Thank you so so much!!!

She needs 5 years as PBS Dependent to qualify for ILR and can only apply for ILR when you do or once you already have ILR.

The 2.5 year visa is a completely different visa category and not relevant to your circumstances.
Or can she just keep applying for a dependent visa every time I extend my tier 2 visa?

Thanks a lot CR001,

So we cannot apply for ILR at the same time. I should apply ILR first after 5 years and if the result is positive then she can apply afterwards? Will her PBS dependent visa still be valid when I have ILR?

Another question I have is about the extension of our visa. I can apply for extension 60 days before my visa expires. But then she can only apply for visa extension after I got mine extended, right? In that case her visa may have been expired while she is waiting for the result of her visa extension application? Would that affect her eligibility to work? Thanks again. :)

Hi there,

Another question I have is that my girl friend currently is on a tier 5 YMS visa, can she apply for PBS dependent visa in the UK without going back to her home country after our marriage?

Also, when I looked at the online application form for PBS dependent visa, there is this question:

"Do you currently have a valid visa or leave to remain as a dependant of a points-based system (PBS) migrant?"

When my wife-to-be answers this question, should it be no? Or yes and then enter her tier 5 YMS visa details?

If I choose No, then the system will ask me to provide proof for our relationship, if choose Yes and enter her tier 5 visa details then the system won't ask me to provide such proof which is odd. So I am a bit confused here as I am afraid that if I choose No, then they may think that my wife-to-be is on a visitor visa and will therefore be not eligible to apply?

Well it would be NO as she does NOT hold 'leave to remain as a PBS Dependent' NOW.
