Switching from T2 ICT Long Term to T2 General dependent

Post by mmani » Fri Feb 01, 2019 11:45 am

Hi,
I'm currently holding T2 ICT Long Term visa expiring on 09-09-2020. I'm planning to switch to my husband's visa as T2 General dependent. I have few questions regarding the process.

1. Do I have to inform my employer before making an application or can I wait until I get the new visa? If I choose to wait would it affect the employer in any way?

My husband is planning to apply for ILR by first week of Oct 2019. His visa is valid from 27-10-2014 and extended until 07-10-2019.

2. Since my dependent visa would also expire at about the same time he applies for ILR, can I make an application to extend my PBS dependent visa along with his ILR application?

Would greatly appreciate your advice.

Thanks

You must tell them AFTER you get a new visa. Whether your employer chooses to keep you is up to them and not an immigration matter. Not sure why you think you changing visas will affect your employer.

You will only get a dependent visa valid till the same date as your spouse.

Yes, obviously a separate application on the appropriate online form and not as a dependent on his ILR application.

Thank you CR001.

So my understanding on point 2 is that my husband will submit ILR application and I will make separate application at the same time for dependent visa extension, but on what basis do I request extension since no decision on the ILR application would have been made yet?

I am also planning to switch my T2 ICT dependent children to my husband's T2 general visa as dependents. Will they be eligible to apply for ILR along with my husband?

Thanks again!

When does he qualify to apply for ILR??

No they won't. They will qualify for ILR when you qualify for ILR.

His T2 General visa was granted from 27-10-2014 and after extension until 07-10-2019. He would qualify to apply in Oct-2019 (taking the 28 days into account) before his visa expires on 07-10-2019. That's when my dependent visa would expire too, that is on 07-10-2019.
