British Citizenship / ILR

Hello Everyone,

Current Nationality: Indian.

I've got my initial Tier 2 ICT Dependent visa on,
Issued on: 09/07/2014
Valid Uti: 26/04/2016
Type : ICT Tier 2 Long Term Staff Partner.

Renewed on,
Type: PBS Dependent - Leave to remain.
Issued on: 25/05/2016
Valid Until - 6th May 2019

My husband received his UK Citizenship on 05th October 2016. Could you pls suggest whether I am now eligible to get British citizenship OR Do I need to get ILR first then apply for citizenship after 12 months time?

Assuming you meet all the standard requirements, including permitted absence in the qualifying period, B1 level English and the Life in the UK test, you can apply as soon as you have been granted ILR.

Thanks Casa, So I've to apply for ILR first before proceed to citizenship. I will complete 5 years period of dependent visa by 09/07/2019 but my current PBS dependant visa expires on 6th May 2019. Lack of 63 days, do I need to apply for PBD dependant visa again for this 63 days OR I am eligible to apply ILR by now? Thanks for your help.

You will have to apply for a FLR(O) extension to make up the short-fall.

Sorry Casa & CR001, you mean I will have to renew my PBS dependant visa for shortfall of 63 days then apply for ILR by 9th July 2019 (That's when I complete 5 years since 9th July 2014)?

Also my husband got his UK Citizenship on 5th Oct 2016, in this route am I eligible to apply for citizenship by 5th Oct 2019( Married to british citizen and lived in UK for 3 years.)? Thanks for your valuable suggestions.

Likely yes and then vary to ILR.

The requirement is NOT being married to a BC for 3 years. It is being married to a BC at the time of applying, even if he became British the day before you apply.

Since my husband is British citizen, so as soon as I obtained my ILR then I am eligible immediately apply for british citizenship,. i.e. I DON'T NEED to wait for 12 months after getting ILR. Isn't it? ( In this way I could save some money and time before home office increase their fee.) Pls suggest.

Correct, provided you meet the 3 years residence requirement, absence limit and the physically present 3 years ago mandatory requirement.

Currently my visa is PBS dependant leave to remain. I will have to renew my PBS dependant visa for shortfall of 63 days then apply for ILR by 9th July 2019. My husband is british citizen( He has granted with UK citizenship thru ICT long term visa). When I renewed my PBS dependant visa, been informed by immigration health surcharge website that I dont need to pay any health surcharge and got the reference number.
- Could someone pls tell me for how long this reference number is valid?
- Can I use this previously used reference number again to renew my PBS dependant visa now?
- When I am trying to get a new reference number, health surcharge website is asking my husband work start date and end date - what do I need to enter here since he is UK citizen now?
