and is the continuous residence will affect her application

Has she held a PBS dependent visa since arriving in the UK and not switched visa category to flr m??

There is no absence limit for PBS dependents whosr visas were issued before 11 January 2018.

Presumably you hold ILR or British citizenship already?

Thanks for the reply
yes she held PBS dependent visa since arrival in UK and still have it. not switched to any other category.
i just been granted ILR on TIER 2 general 5 years route.
as you said there is no absence limit for dependent granted PBS before 11 jan 2018, she can apply for her ILR now isn't it.

thanks

Hi
Thanks for the reply. I do have one more query.
Do my wife will qualify for ILR if there is a gap between expiry of last visa and getting a new after that.
To be specific her first pbs dependent Visa was valid until 06/03/2017 and the new visa has been granted from 18/04/2017.
I have applied for my tier 2 extension first and then applied for her as my dependent.
Please let me know if it’s ok to consider this for five years towards ILR

Thanks

If she applied before her visa expired in March 2017, then there is NO gap.

You are overthinking.

She applied after her visa has expired as I I was waiting for my visa to granted first.
My visa has been granted on 08/03/2017 and then I applied for her as she was not in UK to apply together.
Her visa was expired on 06/03/2017 and new application has been submitted on 03/04/2017.
Is it gonna be a problem???

tier 2 general dependent visa to ILR

Post by sureshkalane » Tue Feb 12, 2019 4:23 pm

hi
can someone please advise me for the following query.
my wife is supposed to apply for her ILR in march 2019. but i am confuse about her eligibility as there is a gap of more than a month between her first TIER 2 dependent visa expiry and extension visa approval.
the application for extension submitted after her visa expires.
Her visa was expired on 06/03/2017 and new application has been submitted on 03/04/2017. as she was not in UK so could not apply with my extension application and has to wait for my visa been approved before she could apply as a dependent.
please advise

thanks
