Dear Admin
My wife came in the UK in may 2011 as a student visa dependant.i have applied for visa extend in June 2012 and she was with me. Home office refused my application and gave me right of appeal.
I have appealed and got hearing date 4 september 2014 but 21 August Home office withdrawal Appeal and wrote me they let me know. In the mean time I was eligible for ILR long Residence Rote. I applied and got visa in 2017. In 2015 capita contacted with me about my wife visa. They asked me there is no information about my wife, then I have provide home office and court withdrawal letter. Capita replied with thanks after that yet I didn't receive anything from home office about my wife visa.well six months ago I gave section 120 notice to Home office but noting received.
At the moment I have three British citizens children.
My question to you 1. Is she living in the UK by law ?
2.what kind of visa need for her?
Please let me know.

Presumably you only appealed YOUR visa refusal and not hers.

Did HO not write to you to ask about her status??

When did her last visa expire?

When you got ILR based on long residence, she should have applied for FLR(FP) Partner route if she had not valid leave to remain.

home office didnt write anything about her status.
visa expired in December 2012 but application pending before that.
i got ILR in october 2017.
we have three children british citizenship holder.
can she apply any other application
is she can apply any other route without partner route.
please let me know.

If you did not appeal her visa refusal back then, she has been an overstayer since her last visa expired.

She should apply on FLR(FP) 10 year partner route.

Thank you for reply.yes I have appealed for her and she got hearing date on 4 September 2014 but we have received a Appeal withdrawal letter from home office and court. Home office wrote us they will make decision later on but not yet.
