Spouse visa help!!

Hi all,

I have been following this board recently and I must say it is very useful.

I married to my girlfriend back home in a register office in 2014 when I was on tier 2 visa. After a couple of months, we decided to end our relationship and I came back to the UK when she got married to someone. I have a document saying that it all got settled but didn’t apply for divorce as she doesn't want to know her husband.

I have never applied a visa to her as we didn’t plan to live together. After that, I have applied a tier 2 visa for myself in 2015 and 2017. I received my ILR through Tier 2 General 5-year route in 2018 Dec. In all these visa applications I have mentioned my status as single which I realized it now could cause a problem.

As you can clearly see, there is no need for me to hide my marital status for all my tier 2 applications as I always thought I am single and it got settled. I will start the divorce process now to submit for the future spouse application. I never needed to tell the home office of my 1st marriage as it got settled and didn't apply for her visa.

Does home office revoke ILR due to deception as I mentioned my marital status as a single in previous applications?
If not, how can I bring my future wife to the UK without any refusal?
What options I have got if my first wife doesn't cooperate for divorce as she doesn't want to know her current husband?

your help on this is highly appreciated.

If you were issued with marriage certificate and the marriage was registered there (back home) and you both were free to marry then that marriage was a legal marriage under HO eyes too. Therefore, it might become a case of deception only when it gets discloses otherwise no issue.
