Tier 4 visa application after Tier 2 ends

Tier 4 visa application after Tier 2 ends

Hi all,

I am a bit puzzled about a few things regarding Tier 2 and I would be grateful for anyone who has any insights on the matter.

Having completed my master's degree in the UK, I got a job with my current employer in 2017 and have been working for them for almost 2 years now. Some of us at my current department have just been informed that due to budget reasons, our employment will come to an end at the end of March. My Tier 2 visa is valid until Jan 2021 but obviously it will be curtailed after March/ April.

My question is around the cooling off period. I'm waiting to hear back from a few universities regarding my phd applications and they all start around September time. An acceptance letter from one of them would mean that I would be applying for a Tier 4. However, given that we are allowed to apply for the Tier 4 visa only up to 3 months before the start of the course, I am afraid I won't be able to switch from Tier 2 to Tier 4 immediately as I will only be able to apply for the tier 4 in June/ July time, whereas my employment will end in April period.

Is there a cooling off period for applications to Tier 4 after a Tier 2 is curtailed or does that only apply to Tier 2 applications? Would I be able to apply for tier 4 without having to wait for 12 months? I thought the answer was yes but internet has confused me quite a lot.

Any help would be much appreciated!

You seem to be confusing things.

There is NO cooling off period for changing visas from Tier 2 to Tier 4. Curtailment notices get sent out a few weeks, sometimes months, after your last date of employment.

Yes, but only for Tier 2 applications outside the UK when the last leave to remain was Tier 2.
Would I be able to apply for tier 4 without having to wait for 12 months?
There is no cooling off period.

Thanks so much for your reply. I've just heard a few contradicting things from various people and I guess I was trying to find out whether I would still be able to apply for a tier 4 visa even if my tier 2 ends before I could switch.

You will have couple of options:

1- Search for new Tier 2 Sponsor and switch employer ASAP, You have 2.5 months until March and you will get minimum 60 days after March once UKVI curtail your VISA (Also with the chance to get even more time if they curtail your VISA with delay).

2- If you want to do PhD, I know that some universities accept PhD applications anytime in the year. But getting an admission in PhD can be a lengthy process like 4 months (according to my experience) before you get CAS and apply VISA.

I was also in similar situation as my job was ended in mid March 2018 (as Company went to Administration) and after a long waiting time I managed to change employer in Dec 2018. My VISA was curtailed to end of July (Notified in May). I tried Tier 4 option but I was not able to get admission due to less time and the last option which worked for me was Tier 2 (Change of Employment).

Also there is no cooling period will not apply to you for either switching to Tier 4 or Tier 2.

I hope this will be give you some idea to plan further.

I have been in UK for 9years.
In Tier4 -5years- BA-business studies and ACCA
Tier 2 -4 years now
Am i eligible to apply for MBA now ? am i eligible to ILR 10yr route? This year sep.finishing my 10yrs.
Please any one give me suggestion
