Third tier 2 dependent visa extension

Post by cs2020 » Fri Feb 22, 2019 10:11 pm

Hi,

Hope you are all well. Please could you help with my immigration query. I wasn't able to find a similar immigration situation in the forum questions.

1) My husband recently got ILR in Jan'2019 through Tier 2 five year route
2) I joined him in 2015 for 4 months on a Tier 2 dependent visa after which I left the UK due to career reasons and pregnancy. I understand this won't be taken into account for my ILR eligibility.
3) I rejoined in Sep'2017 with our child (born outside the UK) on my second Tier 2 dependent visa that will expire in Dec'2019. I will be eligible for ILR in Aug'2022 (5 year period).
4) Reading through forum discussions, I understand I can continue as Tier 2 dependent till ILR.

Please could you help clarify:
1) Can I continue on my current Tier 2 dependent visa (valid till Dec'2019) or do I need to apply for an extension immediately as my husband has got his ILR now
2) If my husband changes his job (that will invalidate his COS that resulted in my Tier 2 dependent visa), does that impact the answer to the above question 1.
3) How many Tier 2 dependent extensions are allowed as my husband is now already on ILR and I need approx. four more years to qualify for ILR
4) As above, what would you recommend for my child who is also on the Tier 2 dependent visa expiring on Dec'2019

Thanks a lot for your help.

Kind regards,
CS

What was the expiry date of your visa you got in 2015?

What date did you apply from home country for the second dependent entry clearance visa?

You can apply shortly before your visa expires.
2) If my husband changes his job (that will invalidate his COS that resulted in my Tier 2 dependent visa), does that impact the answer to the above question 1.
You are dependent on your spouse, not his tier 2 sponsoring employer. No effect.
3) How many Tier 2 dependent extensions are allowed as my husband is now already on ILR and I need approx. four more years to qualify for ILR
There is no limit on how many extensions you can apply for as a PBS Dependent.
4) As above, what would you recommend for my child who is also on the Tier 2 dependent visa expiring on Dec'2019
Same visa route as you. Apply for an extension and then ILR when you qualify.

Note also that IHS has doubled in January and will be £1200 for each applicant for a 3 year extension plus the visa fee.

Dear CR001,

Thank you so much for your timely response. Wish you all the very best.

Kind regards,
CS

P.S. My first visa expired in Dec'2016 and I applied for the second one in Aug'2017 from my home country. Hence my belief that the 4 month initial stay won't count for ILR.

Your residence clock for ILR was reset to zero when you applied for a new entry clearance visa in 2017 as far as I understand the rules.
