28 day rule ILR as Spouse

Hi all,

Timeline for my husband -

1st Spouse visa issued - 8/4/14
Uk entry - 2/5/19
FLR expiry - 13/5/19

After reading on here, I am under the impression that we can apply for ILR from 2/5/19 minus 28 days.

We saw a solicitor today who advised us to apply on 2/5/19 but before 13/5/19.

We want to apply as early as possible so does anyone have a government source that confirms the 28 day rule?
