ILR based on Long residence of the main applicant then what route for dependent?????

Hi,

I am new to this, I will be thankful if you can advise Please!!!


I as main applicant is on Tier 2 General visa since oct 2014 to oct 2019. Applied for direct 5 year route on this. Also got visa for My wife as Tier 2 PBS dependent after that. I am completing my 5 year route as Tier 2 general in oct 2019, but before that in August 2019 I am completing 10 years so I am thinking to apply for ILR based on 10 year route as most of the forums says its much safer route.

1) Please can you advise if I apply for ILR on long residence and after I get my ILR, can my wife apply directly for ILR after her 5 years as PBS dependent in OCT 2019 or she need to switch to FLR for next 5 years?

2) Also, If I get my ILR as long residence then is it necessary for my wife to switch visa at same time or she can stay on existing visa until her 5 years is completed as PBS dependent?

3) What is the best possible route according to you?

No she cannot apply for ILR based on PBS Dependent visa if you apply for and get ILR based on long residence. She will have no option but to switch to FLR(M) and meet the English and financial requirements. Her clock for ILR based on 5 years will reset to zero and she will need 2 x 2.5 year visas.

She can change at any time before her current visa expires but she cannot apply for ILR based on PBS Dependent. The sooner she applies to switch visas, the sooner her new 5 year clock will start. Note also that it is risky for her to stay on PBS Dependent once you get ILR LR if she plans to travel out of the UK.
3) What is the best possible route according to you?
Apply for ILR based on Tier 2 if you meet the requirements. When wife has 5 years on PBS Dependent, then she can apply for ILR based on PBS route.

I appreciate your answers and suggestion. I can apply for ILR based on Tier 2 general 5 year route but I recently got Salary increased to 36.5k and its only 8 months until my 5 year visa expires. Before this I was on 24.5k. So I assume sudden jump of up-to 10k would doubt the case worker Hence I am thinking to apply on 10 year route. As it has got no minimum salary requirement. What you say on this? Please !!

Your choice if you want to risk ILR on Tier 2

What is your SOC??

What was the reason for the large salary increase?? Presumably not everyone in the company received £12k increase (which is 50% and will be an instant red flag to HO).

Thanks CR001,

I think I should go for 10 year route, as I do not want to risk.

I am working as Dispensary manager in a Pharmacy, The Increase was because of more responsibilities in pharmacy and managing it. Also, this also includes overtime of around 7-9 hours a week in it.
