Tier 2 ICT to Dependant-Visa Change

Post by narass » Sun Mar 03, 2019 2:14 pm

Hi Team,

My wife is working in UK under Tier2 ICT Visa category for the past 8.5 years from Dec'2010 and waiting to apply for Permenanent Residency under long residenc category in Dec'2020.

1. Will she be able to change her Visa category as my dependant (I am also working in UK under ICT category for the past 8.5 years)?
2. If Yes, can the change in Visa category from ICT to Dependant be done within UK (while working in UK) or need to travel back to home county to apply for switching visa?
3. If she changes her Visa category from ICT to Dependendant, will her clock for PR (Long residency settlement) get reset ?

1. Yes she can.

2. She can apply within the UK.

3. No, not for long resident ILR. It only resets for ILR based on 5 residence.

Hi CR001,

Thanks for your reply. Just need little more information on point 3,

1. If she changes her visa category now from ICT2 to dependant, does she need to spend another 10 years under dependant category to be eligible for long residency or just 1.5 more years will be enough (8.5y under ICT2 and 1.5y under dependant visa) ?
2. Does she need to take life in the UK test ?

1. Just 1.5 years. All visas count for long residence, including visit visas.

2. For ILR she needs English B1 and Liuk.
