Can I travel outside UK when my wife's application is with HO?

Post by xaozhanglei » Mon Mar 04, 2019 9:30 pm

I just got my ILR and my wife intend to submit her first spouse visa (we are both in the UK).
Can I travel outside UK when my wife's application is with the home office? I know when my own ILR application was with HO, I can not travel outside the UK. Otherwise, will be considered as withdraw. But not sure as a sponsor for her application, if I can travel outside.
Since she might not use the super priority service, which means she has to wait up to 6 months, it would be a very big constraint if I can not travel outside the UK.

Another question is if she is rejected (though very unlikely), is her current T4 visa still valid?

As she is holding a T4 visa valid for another 2.5 years, anyone can tell, if it is a good idea to apply as soon as possible or wait when her T4 visa is going to expire?

Many thanks

If she is going to university/college and still got 2.5 years of valid tier4 visa then why not you travel first then after returning apply spouse visa. Otherwise if you wish then can apply now if you can meet the requirements because still you can travel during the application but how about if HO want to speak or interview you along with applicant.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Many thanks for your kind reply. Actually, due to my position nature, I have to travel outside the UK regularly, every 1-2 months travel once and stay outside UK 1 week each time roughly. You mentioned that there might be an interview, does it happen very often? will them give a notice through email or make an appointment, or just call me without any appointment?

Thanks.

If your absence will be just 1 week every 2 months then I guess you can still manage such interview if HO wanted that.

Many thanks seagul! Do you know when interview is required, will them write an email to arrange an interview or just give a call without any sign in advance?

HO has different tactics so no one can exactly predict that. But as per member experiences either they randomly call the applicant & or sponsor or give them a future date to visit them for interview. Not everyone gets interviewed.
