Company lost its job sponsorship license

Post by mithronius » Wed Mar 06, 2019 3:09 pm

Hello all,

I am an Indian citizen working in the UK on Tier 2 general visa. I had a three year visa and my visa ends in November 2019.
My visa was sponsored by a consultancy that recently lost its sponsorship license.

I have many questions to ask, so if anyone has any insights into this issue, kindly let me know.
I am currently waiting for a "curtainment letter" from the Home office.
But I am trying to figure out few things-

1. What is my current visa status?
2. MY employer said that I am eligible to stay in the UK for 60 days to find another sponsorship. Has anyone been in this situation before?
3. How easy is it to transfer job sponsorship to another company in my situation? I have applied for a FTC role in a company I was working for, and there are strong chances of me getting that job. But I do not know how to go about it.
4. Would it being an FTC role affect anything?
5. How long does it take to transfer job sponsorship?

Hoping to hear from you soon.
Thank you,
M

1. Your existing visa conditions continue until HO curtails your leave.

2. The 60 days starts from the date of curtailment letter and NOT from the date of your last employment. You have the time now and the 60 days to find a new sponsor. Yes many have had curtailments, nothing unique.

3. How easy it is depends on your job and skills.

4. How long is the FTC for?

5. You don't 'transfer' job sponsorship. You have to apply for a whole new visa and pay all the fees and IHS again to change sponsors. Presumably your potential new sponsor is a licensed HO sponsor??

You say a 'consultancy'. Were you contracting under the consultancy or a PAYE employee??

Hello,

Thank you for responding to my enquiry.

The FTC role is for 12 months. The lady in that role is gone on a 12 month maternity leave.

Yes, my potential sponsor is a licensed HO sponsor. I was contracting under the consultancy.

You are not permitted to 'contract' on a tier 2 general visa. It is a breach of your visa conditions. Is this the reason the sponsor licence was revoked, due to not being a genuine employer??

Did they charge you a monthly 'fee' or 'commission' or for your initial CoS?
