Tier 2 general or ICT??

Hi experts, I am new to this forum.

I am currently working in India, with an Indian company who also have a branch in the UK. My company is transferring me to the UK on long term Tier 2 ICT visa.

My company has both Tier 2 general and Tier 2 ICT sponsor licences.

Can I ask my company to do Tier 2 general instead of ICT? If I do that, what are my chances of getting Tier 2 general visa?

Please help. Thank you.

For Tier 2 General, they would have to complete the full and proper RLMT process to prove to HO that no British/EU or settled person is available for the job.

Depending on the SOC, there is a minumim salary that must be met to get a RCoS.

Thank you very much for your answer. If they do RLMT, and offer me Tier 2 general, would HO reject my application saying I should apply ICT category since I work for same company for last 3 years?

Am I eligible for Tier 2 general for same employer if they do RLMT inline with HO guidelines?

My salary offering is £58k, for software developer role so it should be okay I think

Should be no reason to refuse if your sponsor holds a tier 2 general licence and completes the full and proper process before requesting an RCoS, which either granted or refused at the monthly allocation meeting usually held on 11th-13th of each month.

Once the RCoS is approved, only then can you apply for the visa.

Of course it is up to your employer whether to sponsor you for Tier 2 General rather than Tier 2 ICT.
