Gap while switching from Tier 2 ICT Dependent to Student Visa

Dear All,

I wanted to switch from Tier 2 ICT Dependent visa to Student Visa as my current dependent visa is going to be expire by end this March,hence I am going back to my home country to get the student Visa.

I will be out of UK for 45 days (without any visa) to get the student Visa. If I come back on student visa by mid of May - Will it be considered as continuation to my previous stay (as I completes my 5 years stay on Tier 2 ICT dependent visa this march), if so, I will look forward for 10 years route?

Your kind response on this would be much appreciated - Many thanks in advance.

Tier 2 ICT route does not lead to ILR if it was granted in the last 5 years, so your return on Tier 4 will at best restart your clock for ILR.

All visas count for 10 years long residence ILR. Make sure you leave the UK with a valid visa and return with a new visa within 180 days so that continuity of residence is not broken.

Get where you are coming from - Tier 2 ICT does not have a 5 year route, but counts towards 10 year route...

Many thanks for the response. Yeah, I will be completing my 5 years stay this March on Tier 2 dependant Visa. I will come back within 180 days with Student Visa. There will be no visa for 180 days before I get the Student Visa. Hope this would still be eligible for 10 years ILR route.
