Rejected DV ILR, now want to come back and live

Post by Tymgym » Fri Mar 22, 2019 3:21 pm

Hei All,

I use to live with my husband in the UK, was on FLR. He is British. When we had fight between us in the second year with all swearing and physical violence, I applied for ILR under domestic violence route and got rejected. The reason being not enough evidence to prove physical violence. I had to leave the country, they held my passport and brp at asked me to leave and collect them at the airport. There’s no overstay and I left 2 weeks from their decision. Now after about 4 years, we are planning to live together again, and my husband is happy to sponsor me again.
We didn’t apply for a divorce either. We’re just separated.
What are the chances of getting a settlement visa now? Now we both realise our mistakes and have been meeting in person (in Malaysia) and want to live in the UK.
Can I apply now, or will it be rejected, given I have to pay a huge fee now?

Regards
Tym

Exceptionally strong subsisting relationship evidences will be required in that case.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

There were flight tickets that my husband used to visit Malaysia , three trips last year, and mostly we make whatsapp video calls. Have received some money through western union occasionally. Aren’t these not exceptional?
If there are any suggestions that we can do to prove the exceptional relationship, please throw some light!

These are quite simple. You might have to justify that how you both have reconciled your differences formally/informally? You both might be interviewed too by the caseworker.

Oh... did you mean formally means as in like a post nup or any agreements etc?
Informally is like we make calls most of the time. A screenshot of what’s app should be fine I guess.

Am ok with interviews but the time zone will be a problem! Are they random calls or a scheduled interview call, any ideas?

We reconciled our differences basically by me realising my stupidity and assured him like our life will be happy as we had in our first year of marriage.
