PBS Tier 2 general visa dependent BRP not available

Hi
I went through whole immigration board forum and didnt come across anything similar to my case.its very worrying.
My wife Started working in UK on 4th january 2016 and she has tier 2 general visa. I have got tier 2 dependant visa.We arrived together in uk on 29 dec 2015. she applied for her visa in malaysia and i applied in Dubai
We both got same uk entry clearance 30 days vignette but I was not given my decision letter.we cleared uk immigration without any hassle and entered uk. I only realised that i dont have my decision letter when we had arrived in the UK when I saw my wife's decision letter . As we both had same brp collection point we assumed both our brp will be available to collect (even without as decision letter in mycase) eventually but when we went there only my wife's brp had arrived and not mine. Since then I have been trying to contact the home office <BRPCollection@homeoffice.gsi.gov.uk> for which i didnot receive any response.We were informed at the postoffice there are many instance where people receive their BRP after 2 to 3 months and it might arrive anytime. So we have been visiting the post office on all delivery days to check if we had mine ready.Finally I got an email for the homeoffice stating that my BRP is not due as my visa got expired 6th Jan. It was shocking to see this response as
1. they did not even know that mine was not a '30 day visa' and it was 30 day entrance clearance vignette 2. they responded after my visa expired.
We have raised this issue and responded to the home office email. But we are very much stressed and are clueless what to do. Kindly advise.

1. If you have travelled within the period stated on your initial visa, then, you are safe. Now i dont know why you did not receive a letter stating where you will collect your BRP? did u get that letter when u applied for from Dubai or Malaysia?, If so, re email them and clarify.

2. I would suggest, you also send a copy of the email Explaining A-Z of everything to Home Office, complaint section, google Home Office contacts. Have patience, sometimes, they mess up, but they will fix it.

Thanks very much for your response.
My wife got the decision letter,she applied from malaysia. i applied from dubai and i didnot receive any letter.
I have emailed the concerned departments here in uk and also dubai. More stressing is they don have a specific email id refering to concern person. The only email i find in there website is the general one which is BRPCollection@homeoffice.gsi.gov.uk. Is there any other email id other than this.

Apart from all this my foremost concern now is that 30 day entry clearance vignette expired on 6th january 2016 and there is no information on my brp and i am now worried if this would be considered as overstay without any fault of mine.

No update or replies from home office yet.
I have posted a letter along with along all documents to RCU error ammendment unit explaining the whole situation. I don stay close to london thats why i cant visit the office directly or else i would have done that. This is getting very stressful right now as my entry visa has also expired.
Kindly advise what i should do. Expecting a reply

I dont think u need to worry. Your 30 days visa was to be used to enter the uk. it doesnt mean that you do not have a visa anymore.
First thing u need to do is relax. You are not breaking any law by being here. even though the intiial 30 day sticker has exired, since u did enter uk within the stipulated time, you should be fine.
Now comes the more important thing of sorting this out. first is that even if u lived in london, you can not visit them.
when you say u didnt receive the approval letter, what does that mean? u applied for a tier 2 visa, (i suppose u must have done it after your wife had got her tier 2 visa, is that correct?). you submitted all the docs and then u get the passport back with a sticker allowing you to enter the uk within 30 days? is that all correct?
what else did u receive with your visa and passport in dubai?
whatever happens, it may take a little longer, but there is no reason to panic, relax and continue sending emails etc to all parties concerned, and it will be solved.

Thank you very much for your reply and kind words.
All my documentation were correct and i also rightly received my 30 day entry clearance sticker in my passport. I was also supposed to get a DECISION LETTER along with my passport which i didnot receive. The decision letter is only to confirm the date and location of post office from where you have to collect your BRP.It is not mandatory for BRP. You just need to show your passport in post office to collect BRP.
I only realized that I dont have a decision letter only after i saw my wife's decision letter after we arrived in uk. but i already knew the location of post office from where i have to collect my brp since i already mentioned the address while submitting my application.
After checking in post office, I mailed home office brp collection on 30 dec 2015 that my BRP has not arrived.one week passed they dint reply me back. I again remailed them on 8th jan. After 2 days i got a reply

You are not due to receive a BRP as you were only issued with a 30 day visa which expired on 6 January 2016.
If the Permit Holder wants to remain in the UK for a further period, they should apply for permission to remain here on the application form specified for the type of application they wish to make.


I was shocked to see the reply. I replied to them explaining to them that i applied for long term dependant visa and received 30 uk entry clearance and not 30 days visa so I SHOULD BE ISSUED A BRP to continue my stay. I guess they confused my entry clearance sticker with 30 day visa although my sticker say

Type - tier 2 partner
obsrv - Pbs dependant , work permitted, no public funds.

I believe they have a different sticker for 30 day visa.I keep mailing concern departments and there is no quick response.I have also send all my docs and letter explaining the situation to RCU croydon by special mail delivery. Is there any way i can find a specific mail or contact to whom i can talk directly about this so it can be dealt faster. I would be a bit relieved if i get a confirmation that there has been a mistake and they are rectifyin them.

Have you saved a copy of your visa application form or kept a print out of the same? If yes, then do check what you have filled in there. Whether you requested for Tier 2 PBS dependant visa for 30 days (by mistake?) or 3 years should be clear from that application form.. and then it would be clear where the fault might be.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

I just checked my application form and I have clearly mentioned TIER 2 GENERAL PARTNER UPTO 3 YEARS.
I have paid a visa fee of 885$ which is a fee for long term. The sticker has the name UK ENTRY CLEARENCE and not VISA, so iam sure i have entry clearance and not short term visa.

Right, that's a good start. Hopefully it might be a mistake from UKVI.

I'm sure you are pretty stressed out about this whole thing, however, you did your best to inform them.. (keep calling them on regular basis until you get a response).

Why not try contacting your 'home country' consulate office in the UK and explain your situation? May be they could help you out by making contact with the UKVI authorities.

Its going to be one month since i last posted. I HAVE NOT STILL RECEIVED MY BRP.
I received letter from home office to re enrol my biometrics 27 jan 2016, immediately next day i went to post office and enrolled and got acknowledgement that its sent. They said i will get my brp within 3-7 days. its going to be 10 days now but nothin yet. I haven't gone out of home from the day i enrolled fearing i will miss the courier. I have been mailing and cheking dx courier to chek if they have any delivery for me from home office under my name. I mailed home office two days back and they mailed back sayin

You should receive your permit within 7 working days. However, if you do not receive the permit(s) within 10 working days of the date of this letter, please use the service at http://www.gov.uk/brp. first of all i have not applied for replacement. I didnot receive my brp at first place due to the error commited by them as i have mentioned in the previous posts.Now they are asking me to wait for another 10 days and the amazing thing they are saying is if i donot receive it in another 10 days i should use the services at www.gov.uk/brp. this is ridiculous.!!! The link takes back to new application and fees and everything which means i have to do the whole process again. why the hell shud i do the whole thing again because of the error comited by them. I have already spent so much extra money on this. I have sent a mail to complaint@homeoffice as well explaining whole situation.The automated reply i received is they will reply within 20 days which i donot believe.
Guys is there a way to contact some persons directly regarding this issue. right now i only have is general brpcollection,brpdelivery,brperror emails. Kindly help me out. waiting for your advices

I seem to be in the same situation. Except that I am the main applicant and I have not got my BRP. Strangely my wife got her BRP on a dependent visa.

Home office uk is really messed up.I got my BRP after a lots of follow up mails.I dont know whats your position exactly but keep mailing them like twice a week.
You said you are the main applicant so I suggest you to inform your sponsor/company/university. They will take care of the further process and you don't have to go through all the headache.
