ILR application using the SET (O)

Post by ATI Kiwi » Wed Mar 27, 2019 2:00 pm

Hello,

I am looking for some guidance on the new SET(O) online process as there doesn't seem to be any guidance from the home office.

I am on a Tier 2 visa which commenced 09 July 2013, was renewed on 20 July 2016 and expires on 10 July 2019. Although my visa has not yet expired (and therefore not within the 28 day period) am I eligible to apply for by ILR?

I am also looking for guidance on information and evidence required for the following:

Immigration History – I have listed the counties I have visited outside of the UK but there is not sufficient space. Is a chronological spread sheet confirming locations, dates, and purpose plus the stamps in my passports (current and expired) sufficient evidence to discharge “reasons for absences from the UK”

Immigration Details – With regards to the following question “Have you previously lived in a country outside the UK including your country of birth?” Surely all applicants will have lived somewhere outside of the UK. What does this question require? I have lived in a handful of other countries as a child, do I need to list these all?

Mandatory Documentation –
Your most recent payslip and your most recent bank/ building society statement. Is only one month required?
What evidence is required to discharge “For the period before you were granted leave as a Tier 2 migrant, documents showing that you met the relevant requirements of the immigration rules.” Would a copy of the visa suffice?

I hope to submit my application in April via the fast route however my passport expires in mid-May. What happens if my passport expires during the process due to is due their delay?

      Thanks for any guidance.

You can apply no sooner than within 28 days before the 5th anniversary of your initial visa ISSUE date. If you apply now, it will be refused and you will lose the fee. Date of application is the date you submit and pay online.

      Fine.

You should list all counties you have lived in, even home country, as the form asks. Not visited though, only residence.

          1. Yes.
          2. If you are ONLY relying on Tier 2 for ILR, then nothing you need to provide. This particular question is for those who are combining time spent on Tier 1 with Tier 2 to make up 5 years.
I hope to submit my application in April via the fast route however my passport expires in mid-May. What happens if my passport expires during the process due to is due their delay?
Why in April?? You don't qualify for ILR in April based on what you have posted. If your visa was issued on 9th July 2013, the earliest you can submit online is 11th June 2019 : Time and Date calculation (click) and you if apply any sooner, you risk being refused outright for failing to meet the residence requirement. You also need a valid passport to apply for ILR, so suggest you renew the passport first.
