Bit of background. I have been in the UK for over 12 years legally (SMP, Tier 1 and now Tier 2 dependant). For various personal reasons, I could not apply for ILR. I missed earlier opportunity to apply for ILR while on Tier 1 due to the Driving conviction in December 2016. I paid, fine, license suspend etc. That forced me to go for Tier 2 (Dependant) on my spouse. This November I will complete 3 years on my Tier 2 dependant visa. Meanwhile, I want to explore if I could apply under 10-year legal stay route rather then go for 2-year extension to Tier 2 dependant visa thus saving time, money and mental agony.
As I understand as per immigration rules 24 months should pass for non-custodial sentence (fine etc) before I could apply for ILR.
1) I want to know first can I apply under 10-year legal stay route to apply for ILR. i.e. from the current status of Tier 2 dependant?
2) Is my understanding correct that since 2 years have passed for my non-custodial conviction? This should not be an issue?
I will appreciate a response from key knowledgable contributors.
