Tier 2 changing employer

Post by Muggy » Wed Apr 03, 2019 8:29 pm

Hi I am new here so not sure if this is how or where I am meant to post my query.

I have a Tier 2 (with 2 dependants). I had been given 5 years from January 2018 to 2023. I have however been offered a job by another employer who is willing to provide me with a CoS (and I have already handed in my resignation with current employer).

I wanted to start filling the application forms but not sure which route to go after reading some of the questions/ comments.
1. Do I make a new application or apply as requesting for an extension (even though my current visa expires in 2023).
2. As I have 2 dependants, do I also make the same application I would be making for myself?
3. As I already have Tier and need to change employer, do I need to provide proof of English language and Bank statements?
4. Can I start working for my new employer while my application is with the Home Office?

Thank you in advance and I apologise if this isn't the right place to post this.

You resigned without having a CoS assigned or a new visa??? What if it falls through or visa is refused??
1. Do I make a new application or apply as requesting for an extension (even though my current visa expires in 2023).
I understand it is a new application for change of employment. You can only apply when you have the cos.
2. As I have 2 dependants, do I also make the same application I would be making for myself?
No, you don't have to apply again for dependents. Their existing visas remain valid.
3. As I already have Tier and need to change employer, do I need to provide proof of English language and Bank statements?
Not sure.
4. Can I start working for my new employer while my application is with the Home Office?
No you cannot. You can only work for your new sponsor once you get a new visa and in line with the job start dates in the cos.

Have the new employer completed the full and proper RLMT process before offering you the job?

Thank you very much for your response. Unfortunately, I didn't know the process, so I just followed my current employer's policy of handing notice of resignation. But I believe I can withdraw my resignation.

I had explained during an interview that I would need CoS which they were happy to provide. I am now waiting for this having already received the offer letter.

That's good that I don't have to make an application for them.

I read someone if it is a change of employer one wouldn't need to submit proof of English language (though I don't mind providing this) and that I wouldn't need to provide bank statements as I would have been working (don't know). I tried ringing HO advise line, they didn't seem to have answers to most of my questions (or maybe its just the person I spoke to).

I don't know if they have completed the RLMT or not. All I know from my previous experience after I was offered the job, I asked for the CoS which was given to me. I'm on the shortage occupation.

IF I cannot start the new job until the visa has been offered, I have a 1-week gap between my last day with the current employer and start date at new employer. Would this be a problem?

Once again, thank you very much.

RLMT not required for shortage occupations. What is the SOC from Appendix k for the new job?

No issue with employment gap.

Thank you.
Its Children and Families Social Worker.

Thank you for the clarification about the employment gap.

I am just waiting for the Cos now. And since you have informed me I don't need to apply for my dependants, then at least I may be able to use same day service.

Thank you again.

Can you please advice which form I am supposed to complete as there are only 2 options. Making a new application or application to extend the current visa.

When I start a new application and put the country I am in, it refuses as I'm in the UK. I am stuck.

Help, please.

Thank you.

From the reply given it is a No. You need to make new application. So, I tried to open/ start a new application but could get past the question where I am asked the country I'm applying from.
