ILR for my family

Post by azizkap76 » Wed Apr 10, 2019 5:13 pm

Hi,

I am British Citizen since Oct 2015. I acquired my citizenship through PBS Tier 2 5 years route. My family came to UK in May 2014. I have my wife, 21 years old daughter and 17 years old son. I want to know
Which ILR forms they have to fill? Is there any different requirements for my daughter since she is now above 18 but holding dependent Visa.

I want to know which forms they have to fill for ILR application
SET(O)
or
SET(M)

Do they have to fill separate forms or can only my wife fill form and then add my son and daughter on it.

To be clear so my previous post is not ignored, why have you registered a second username to post questions. This is NOT permitted on the forum, per link below.

Hi,

I tried to login many times using my previous id. Also tried to reset password using forgot password link. But did not get any email to reset. That's why I created another account. If I can recover/login using my previous user id, then you can delete this one. Also I did not know about such policy. Sorry.

Form Set O for your dependents if they hold a PBS dependent visa for 5 years.

One form for spouse and under 18 child.

Over 18 year old has to apply on their own Form and meet the English and Liuk requirements.

Over 18 needs to provide evidence of dependency and not leading an independent life.

Similar docs might be required for over 16 but under 18 year old child.

There is more than one 'spouse/partner' visa category. Your posts are unclear what category of spouse/partner visa your dependents hold.

What is their exact full UK immigration history and visa category (PBS Dependent or Spouse/child Settlement Visas)??

Hi,

I was settled in UK in Sep 2013 after completing 5 years on Tier 2 Work permit and then got my British citizenship on that basis.

My wife got Visa in Jan 2014 type of visa mentioned on it
VISA SPOUSE/CP - Spouse/CP of A Kapadia

Then there was an extension in Nov 2016 and on BRP card visa type is
SPOUSE/PARTNER
LEAVE TO REMAIN

On my children visas granted in Jan 2014 visa type is
VISA TO ACC MOTHER/CYR xxxxxx

On extension in 2016 they got BRP Card and visa type is
DEPENDENT
LEAVE TO REMAIN

Please advise which form need to submit SET(O) or SET(M)

Thanks for the reply.
But when I am checking on here https://www.gov.uk/settle-in-the-uk
When I reply that settled using work permit tier 1, 2 or 5 I end up with getting redirect to SET(O) online application form.

You are missing the crucial point that they appear to have applied for a settlement spouse/child visa AFTER you got ILR, as the link you provided clearly states, it is then SET M!!
Eligibility for partners
Your current visa must be as a dependant on your partner’s tier 1, 2 or 5 visa.

If you got your current visa as your partner’s dependant after they settled in the UK, you must apply as the partner of a settled person instead.
Your choice if you want to risk it, but applying on Set(O) if they DO NOT hold a PBS Dependent visa for 5 years will result in a refusal and loss of fee paid.

Hi,

Thanks again, yes I checked it again and it seems that they have to submit SET(M) forms. Last question:
Please confirm below
1. My wife and child under 18 can apply on the same form
2. My other child over 18 has to submit separate SET(M) form.
