Does anyone know whether, under the EU settlement scheme, Surinder Singh applicants will have to prove that the British person has been a qualified person since returning to the UK up to the point of applying for settled/pre-settled status?
My spouse (non-EU) got his residence card based on marriage to me (British citizen who had been living and working in Switzerland).
We had to prove that I had been a qualified person in Switzerland to get the family permit (which was easy as I was working there)
We didn’t have to prove that I had been a qualified person in the UK when we applied for the residence card because we had been back in the UK less than 3 months
When we apply for his pre-settled status will we have to prove that I have been a qualified person in the UK? This would be a problem for us because at the moment the plan is for me to stay at home with the children while young and for him to work (he is already working in the UK)
Do I have to work so he doesn’t lose his right to live here?
