Tax Oversight with HMRC

Hello Friends

My husband entered UK on 26th June 2014 along with me(his spouse) and our 2 children (14 and 9 now ). He came in on Tier 2 General visa and we came as his tier 2 General visa dependants. We will be applying for Indefinite leave to remain in June 2019 as we all will be completing 5 years in UK.

The fees for ILR (including super priority appointment) comes to £3200 per person, so for 4 of us it would be £3200*4=£12800, which is super expensive. Even though my husband has been working for the same employer for the past 5 years and continues to do so currently, he suggested that instead of all (4 of us) applying together, it will be better for him to apply first alone and once his ILR is approved successfully, he will apply ILR for dependants.

Is this plan feasible or is it better to apply ILR for all of us together. My query is in which situation do we stand a better chance of approval. Other than this confusion, our ILR application is pretty straightforward.

Any advice to get us out of this dilemma will be very helpful.

He can apply first and then dependents later provided the dependents apply before their visas expire.

You can apply no sooner than within 28 days before this date, so anytime from 9th May onward.

Your dependents can apply at anytime from 9th May but must be before their visas expire.

Note that once you have ILR, you will not be able to apply for the children individually without your spouse dependent. Children can only apply once one parent has ILR and the other parent is applying OR once BOTH parents have ILR.

You can also expect HO to ask you about your dependents not applying with you, specifically the children, so best to include a cover note stating you will apply for spouse and children later before their current visas expire.

Note that you also do NOT have to use super priority for your or their applications. You could do super priority for you and then standard for them later.

Dear friends,

Here I am back with another query regarding our ILR Application. Please bear with me as I am really worried and nervous about our ILR as it is one huge investment for us and our children.

So my question is as follows

My husband is on Tier 2 General visa and I am on Tier 2 General dependant Visa. My husband's been working for xxxx SINCE JUNE 2014(Also currently with xxxx)In 2015, my husband resigned from xxxx (because he got another job offer which didn't materialise) and joined xxxx again in the same month(resignation cancelled).

When we received his P60 for 2015, his taxable income was split into 2 parts( one for time period before resignation and one for later).
So when we filed our taxes, we just put one amount as taxable income( The bigger substantial one)and out of confusion left the other part of income.
We received a refund in 2015(because of our oversight)

In 2018, HMRC said that we had to pay back refund as we had made mistake filing tax. Immediately, we paid the refund of £1250 at once and things got sorted out with HMRC, and our HMRC account shows that all our dues are settled.

My question is as we are applying for Indefinite leave to remain in June 2019, will this impact our chances of ILR.
