ILR application for Child submitted separately

Post by yqs2019 » Fri May 17, 2019 4:05 pm

Hello, I submitted application for my child (14) for ILR as tier 2 dependent in middle of April. It was submitted before her mother and I were granted ILR. My application for ILR was submitted in Feb. and approved last month. For some reason, her mother was not able to submit her ILR application at the same time with me. Finally she submitted her application and was granted ILR by use of superiority service last week. Would my child's application be refused because his application was submitted before his parents were granted ILR? Thank you very much.

BTW, as my child is under 18, I have applied with the form Set(f), is it the correct form? or should I still use the set (o) form? He is tier 2 dependent.
Thank you.

Why did you do that for your child?? Set F is only relevant if BOTH parents hold ILR at the time you apply.

Why did you not wait to include the child with the mothers application?

Hi CR001, I didn't know the regulation and did the wrong way. Even though my wife and I both have ILR now, would my child's application still be rejected because the mother was not granted ILR at the time of submitting child's application? If I need to resubmit application for my child as Tier 2 dependent, do I need to use the form Set(O) rather than Set (F), even though he is under 18? Thank you so much.

If I need to resubmit a new application for my child, do I need to withdraw the previous application? Or just indicate it with the reference number of the previous application in the new application?

You should wait to hear back from HO.

Hi CR001, many thanks for your advice. As his current visa expires in the middle of June, do you think that I had better to resubmit a new application if I do not hear anything from HO at that time?
If his new application is submitted before the current visa expire date, however, the biometric appointment date is already beyond the current visa expire (not easy to get an appointment quickly recently), will the new application is considered as submitted before the current visa expire? Thank you.
